Employees taking Paid Family Leave receive 67% of their average weekly wage, up to a cap of 67% of the current New York State Average Weekly Wage (NYSAWW). For 2023, the NYSAWW is $1,688.19, which means the maximum weekly benefit is $1,131.08. This is $62.72 more than the maximum weekly benefit for 2022.
Employers cannot discriminate against employees for taking Paid Family Leave. Employees with a regular work schedule of 20 or more hours per week are eligible after 26 weeks of employment. Employees with a regular work schedule of less than 20 hours per week are eligible after 175 days worked.
In order to be eligible for Paid Family Leave, a worker must remain in employment for 26 consecutive weeks if they regularly work 20 or more hours per week, or 175 days if they regularly work less than 20 hours per week.
Employees should check with Human Resources about job protection before applying for PFL. that gives eligible employees 12 weeks of unpaid, job-protected leave in a 12-month period to bond with a new child, to care for an ill family member, or to participate in a qualifying military event.
PFL provides up to eight weeks of partially paid leave for mothers and fathers to bond with a new child within the childs first year.
