California LLCs dont pay an $800 fee for their 1st year (if the LLC is formed after January 1st, 2021).
Updated May 5, 2022: The fee is based on the total income of an LLC. Along with the annual franchise tax fee of $800 that is imposed on all LLCs and corporations operating in the state, the additional gross receipts tax applies to LLCs. However, corporations are not required to pay the gross receipts tax.
If you cancel your LLC within one year of organizing, you can file Short form cancellation (SOS Form LLC-4/8) with the SOS. Your LLC will not be subject to the annual $800 tax for its first tax year.
Make a payment online using Web Pay for Businesses. LLCs can make an immediate payment or schedule payments up to a year in advance. For more information, go to ftb.ca.gov/pay. If paying by Web Pay, do not file form FTB 3522.
LLCs file their tax return on Form 568, Limited Liability Company Return of Income, pay their $800 annual franchise tax using Form 3522, LLC Tax Voucher, and pay their LLC fee with Form 3536, Estimated Fee for LLCs. LLC tax returns are due on the fifteenth day of the fourth month after the tax year.
