Use form IHT217 with form IHT205 (or C5 (2006) in Scotland) to claim a transfer of unused nil rate band if the estate is an excepted estate and the whole of the nil rate band is available to transfer.
The Residence Nil Rate Band will be transferable between spouses and civil partners on death, much like the standard nil rate band. It is the unused percentage of the RNRB from the estate of the first to die which can be claimed on the second death.
You must complete the form IHT400, as part of the probate or confirmation process if theres Inheritance Tax to pay, or the deceaseds estate does not qualify as an excepted estate. You can use the notes and forms IHT401 to IHT436 to support you.
Its possible to transfer any unused percentage of the inheritance tax nil rate band from a deceased spouse or civil partner to the surviving spouse or civil partner. A formal claim process is in place when the surviving spouse dies and not when the first spouse dies.
