The benefit of Form 1045 is that the IRS is generally required to process the application within 90 days. Under IRC 6501(k), if a taxpayer files Form 1045 to carry back an NOL, the IRS can assess tax on the carryback year while the statute of limitation for the loss year is open up to the amount of the refund.
Can Form 1045 be e-filed? At this time, the IRS does not allow Form 1045 to be e-filed (refer to Accepted Forms and Schedules). Note that because the Form 1045 is filed separately from Form 1040, the tax return and all other supporting schedules can still be e-filed.
When a loss is greater than the amount allowed by the tax deduction, it can be carried to the following years. This creates a future tax relief, which essentially increased the income of a future year. Different types of loss can be carried over for different number of years.
