A Mandated Person is required to report to Tusla without delay, any knowledge, belief or reasonable suspicion that a child has been harmed, is being harmed, or is at risk of being harmed. This includes where a child discloses their belief to a Mandated Person that they have been, are being or are likely to be harmed.
For the purposes of this article, reasonable suspicion means that it is objectively reasonable for a person to entertain a suspicion based upon facts that could cause a reasonable person in a like position, drawing, when appropriate, on their training and experience, to suspect child abuse or neglect.
Dont: Tell the person that you can keep it a secret. Panic, overreact, be judgmental or make assumptions. Investigate, repeatedly question or ask the individual to repeat the disclosure. Discuss the disclosure with people who dont need to know.
If a child has been harmed, is at risk of harm, or is in immediate danger, schools and colleges are required to report cases of sexual violence and/or harassment to social services.
You should always inform Tusla if you have reasonable grounds for concern that a child may have been, is being, or is at risk of being abused or neglected. You can report your concern in person, by telephone or in writing to the local social work duty service in the area where the child lives.
