The landlord must give the tenant a three day notice, in writing, to evict for nonpayment of rent. The notice must state that the tenant must pay rent or vacate possession. If the tenant does not pay in three days, the landlord may file an eviction action in justice court and obtain an order of eviction.
If a tenant fails to pay rent, the landlord may give a written notice to the tenant. The notice has to say that the lease will end if the rent is not paid within 3 days. This gives a right to cure or fix the lease violation. If the tenant pays the rent in 3 days, the landlord cannot evict the tenant.
Your landlord must give you a written Eviction Notice, sometimes called a Notice To Quit. If you do not have a lease, the Notice will tell you that you have either 7 days or 30 days to move out. If you have a lease then the lease will usually say what kind of notice the landlord has to give you.
3- Day Notice The notice must be for a full 72 hours, and cannot include weekends or holidays. Note that in Franklin County, the 10th Dist. Court of Appeals has said that 30 days notice must be given for nonpayment of rent, if the tenant lives in subsidized housing, or the property is backed by a federal mortgage.
In Florida, including late fees in the amount due, providing less than three business days, or not serving the notice in the correct way (Posting and mailing it if the tenant is not at home) can void the notice.
