If a man has legally adopted the non biological child, then yes. Otherwise, a judge will not force someone to pay for a child when he is not the legal or biological father.
An unmarried father does not have a right to custody or parenting time until paternity is established. An unmarried mother has sole legal and sole physical custody of the child until a court order says differently. Only a legal parent can ask the court for custody or parenting time.
Minnesotas voluntary acknowledgement allows an unmarried person who gave birth and the childs biological father to sign a Minnesota Voluntary Recognition of Parentage (PDF) (ROP) form. When the ROP form is filed with MDH, we will add the father to the birth record, legally establishing the fathers paternity.
The Recognition of Parentage (ROP) must be signed by both parents; you must have a certified copy of the Recognition of Parentage. If you do not have an ROP but you and the other parent are willing to sign one now, you can get a form ROP from your local Child Support Enforcement Office.
If the mother is married and the husband is not the biological father of the child, the husband must also sign a form called the Husbands Non-Paternity Statement within one year after the child is born. The Husbands Non-Paternity Statement must also be filed with the Minnesota Department of Health.
