Contempt of court is a straight summary offence and a person charged is liable to a fine not exceeding one hundred dollars or to imprisonment for a term not exceeding ninety days. A court can choose to impose both a fine and imprisonment on a person charged with contempt of court.
If the other parent doesnt obey a court order, you can file a form with the court called a Motion for Contempt. This motion asks the court to hold a hearing where the other parent will have to explain why they arent following the court order(s).
Motion to Modify By filing this motion, you are asking the court to change something in your final order. You must be able to show that there has been a substantial change in circumstances since the last court order. You cant file a Motion to Modify just because you dont agree with the order.
