A Notice of Intent to Lien (NOI) is a formal warning you send to the property owner or general contractor, letting them know that if they dont pay up, youre going to file a mechanics lien. The goal is to give them a chance to make things right before you take legal action.
Note that the Notice of Intent to Lien is not a required pre-lien notice in California. It is an entirely optional notice that you can serve on the property owner before you record your mechanics lien.
The lien notice lets you know who is capable of putting a lien on your property so you can plan and strategize ingly. The State of California in order requires prelims to protect the contractors right to Lien. It also gives notice to all parties in the project (owners, tenants, etc.) regarding the ongoing work.
A creditor must file and be approved for a property lien through a county records office. Different states may have their own processes for lien filing. Often, the creditor will notify the debtor of the lien.
Because liens are filed against a property, theyre a big red flag to property owners. If youre a supplier or subcontractor hired by somebody other than the owner, the owner will be incentivized to step in and resolve your payment issue in order to have the lien removed.
