If someone writes you a bad check and you cash it, the check may bounce and you could face overdraft fees, a negative account balance, or even be suspected of fraudespecially if the check was fraudulent.
Make no mistake about it, writing bad checks is always illegal. However, just about every state has a statute of limitations (SoL) on the collection of bad checks; typically 2 or 3 years. If you receive a collection notice or call about a bad check, dont panic!
It is against the law to knowingly write a check on a closed account or for an amount which the check writer knows cannot be covered by funds in the account or by overdraft protec- tion. Writing a bad check can also result in a civil lawsuit and civil penalties of three times the amount of the check up to $1,500.
Penalties for Issuing a Bad Check Regardless of the amount of the check, the offense of issuance of a bad check is a Class C misdemeanor. See Tex. Penal Code Ann. 32.41(f). An individual adjudged guilty of a Class C misdemeanor shall be punished by a fine not to exceed $500. Id.
