What is a QILDRO order?

SERS QILDRO Handbook & Forms Qualified Illinois Domestic Relations Orders (QILDROs) are court orders that direct SERS to pay a portion of a member's retirement benefit or refund to an alternate payee, typically a former spouse. QILDROs are issued under the Illinois Pension Code, 40 ILCS 5/1-119.

How does QILDRO work?

A QILDRO (pronounced kwil-dr\u014d) document is a court order issued by an Illinois court. It directs IMRF to pay your alternate payee the portion of your IMRF benefits that you have agreed upon during your divorce negotiations. By law, IMRF must have a valid QILDRO on file or we cannot pay your alternate payee.

What's the difference between a QDRO and a Qildro?

A QILDRO is not the same as a QDRO. Most notably, because a QILDRO terminates on the participant's death or refund terminating the participant's participation in the fund, the former spouse only receives benefits when they are paid to the participant and may never receive a full payment of benefits.

How does a QDRO work in Illinois?

QDROs are court orders that allow a tax-advantaged retirement account to be divided between former spouses. Once you have the order, you earn a right to the retirement plan or benefit. For example, one spouse's 401(k) might get divided in half, with the other spouse getting his or her half rolled into an IRA.
