In Virginia, an adult guardianship and/or conservatorship is created when a Circuit Court determines that an adult\u2014or someone who is almost an adult\u2014is incapable of managing their affairs. The Court appoints an individual or agency to manage the affairs of that incapacitated person.
If the petition for guardianship is not opposed, you can generally get through the process within 60 to 90 days; however, even an unopposed petition can run into obstacles that lengthen the time table. If someone files an objection, the issue must be litigated, meaning it could take considerably longer than 60-90 days.
Any person may file a petition with a Virginia Circuit Court alleging that there is an incapacitated Virginia resident who needs to have a guardian or conservator appointed to manage some or all of his affairs. The person alleged to be incapacitated in the petition is called the respondent.

In Virginia, anyone can file a petition with the Circuit Court alleging that a Virginia resident is incapacitated and in need of a guardian or conservator. The incapacitated person may need help with certain affairs or may require a guardian to handle all their affairs.
