What are the top Trademark Rules? Always use your whole mark. Make sure your mark stands out. Use a trademark symbol. Avoid descriptive words, terms, and phrases. Use your trademark as an adjective. Business and domain names do not protect trademarks. Avoid commonly used words, terms, and phrases.
A mark should always be used as an adjective, not a noun. Your trademark is a particular brand of product or service, not the name of the product itself. In the following example, the generic terms are italicized for illustration only: THE HEART TRUTH public awareness campaign, or HEAD START pre-school program.
You can only trademark a brand name that youre using in business or that you intend to use in business in the near future. Dont register a generic or descriptive name. Your trademark name has to be distinctive or unique in some way to be approved.

DITA includes a trademark (tm) element to identify trademark words or phrases. However, there is specific provision for identifying images as trademarks. The tm element has a required tmtype attribute, which has three valid values: reg.
