A 1099 is a form used in the U.S. to report income other than wages or salaries from my limited understanding. In Canada, there are a range of similar type tax slips, the T4A being one used to report non-salary income, such as pensions, commissions, and payments for services.
If you work with independent contractors, you have to file a Form 1099-MISC with the IRS at tax time. Essentially, the 1099-MISC is to contractors what the W-2 is to employees. It covers income amounts, while also indicating you havent deducted any federal, state or other taxes.
As long as the foreign contractor is not a U.S. person and the services are wholly performed outside the U.S., then no Form 1099 is required and no withholding is required.
In a simple context, you must file 1099 MISC if you have paid any independent contractor a sum of $600 or more in a year for their services for your business or trade. The independent contractors need to report these payments on their tax returns as well.
You should have the following on hand to fill out the 1099-MISC form: Payers (thats you!) name, address, and phone number. Your TIN (Taxpayer Identification Number) Recipients TIN. Recipients name and address. Your account number, if applicable. Amount you paid the recipient in the tax year.
1099-MISC only: Reporting specific types of payments besides wages earned through employment. 1099-NEC only: Reporting nonemployment compensation. Both forms: Using an independent contractor (paid $600+) and paying $600+ in rent.
