The good news is yes, you should be successful with getting the eviction record expunged. Expungements are routinely granted. You would need to file a petition for expungement through the local court where the eviction proceeding initially took place.
If you want to stop an eviction, you must file your appeal before you are removed from the rental unit. Once you are evicted (removed), there is no ready way to undo the removal and get back into the property.
If your landlord is evicting you for not paying your rent, you may be able to stop the process. You may offer to pay your landlord all the rent you owe, plus late fees and the cost of the warrant. In return, your landlord may agree to drop the lawsuit. This is called a settlement.
How Long Does an Eviction Stay on Your Record? An eviction itself doesnt appear on your credit report. However, any unpaid rent and fees could be sent to collections and remain on your credit report for seven years from the original delinquency date.
Once an eviction is filed with the court, the court record may be erased or expunged or taken off your record. It all depends on the county you are in and what that county court allows. In all counties, you should be able to file a request to have your eviction record sealed.
You can file a petition to expunge/seal your rental record at the courthouse in the county where the eviction was filed. You will file the petition and have a copy served on the landlord. The judge will then schedule a hearing and determine if your record should be expunged/sealed.
Once you have come up with a mutual agreement, your landlord can allow you to apply for an eviction record expungement. You should document all the mediation proceedings, such as payment receipts, your mutual agreement and the landlords consent. You will need these documents to support your expungement application.
Texas does not have a process to remove or seal an eviction from your record.
