Expungement in Ohio is a legal process provided under Section 2953 of the Ohio Revised Code. This allows a person to have all references to a prior criminal conviction cleared and their court file sealed. This means that, in the eyes of the law, the case never happened.
An eligible person must prepare and file a Petition for Expungement. The Petition for Expungement must be filed in the Superior Court in the county where the arrest or prosecution took place. A judge then decides whether the person should be granted an Expungement Order.
Update on Oklahoma Expungement Laws Deferred judgments in misdemeanor can be expunged one year after charges are dismissed; Deferred judgments in nonviolent felonies can be expunged five years after charges are dismissed.
In Oklahoma, you can't expunge a “violent crime.” You would be forgiven for thinking that a “violent crime” just means a crime that involves some kind of violence, but the law simply doesn't work that way.
EXPUNGEMENT APPLICATION INFORMATION A non-refundable $50 filing fee is to be paid at the Criminal Clerk's office at the time of application for expungement of a Conviction. No filing fee is required for Acquittals or Dismissals.
