If you are an employee who has been given a non-compete clause with your Employment Agreement, it may no longer be enforceable. Employers are no longer permitted to issue non-compete agreements to their employees in Ontario.
A very basic example of a non-competition clause is, Employee shall not be employed in the horseshoe manufacturing business in Calgary for a period of 12 months after termination of employment for any reason.
An agreement that prohibits the employee from engaging in work that is in competition with the employers business after the employment relationships ends within 100 km of the employers workplace is a non-compete agreement. If the agreement has no geographic restriction it is still a non-compete agreement.
Employers are no longer permitted to issue non-compete agreements to their employees in Ontario. The province is the first in Canada to implement this ban, which came into effect on December 2, 2021.
Non-Competition Agreements in Alberta Because they limit the ability of an ex-employee to earn a living, non-competition agreements must be very carefully drafted in order to be legally valid. They cannot be overly restrictive in terms of length of time or geographical docHub, or they will not be enforceable.
Typically, the only way to fight a non-compete agreement is to go to court.
