But there may be times when you might abandon a trademark purposely or inadvertently or you may wish to use one that was once owned by another. There are two primary ways in which a trademark can be abandoned through nonuse or by failing to move your USPTO application forward.
The trademark can be removed from the registry for non-use, as explained below - Not using a registered trademark for a period of five years starting from the date the trademark is registered. If the prescribed renewal fees are not paid, the trademark may be removed from the trademark registry.
File the Petition: Submit the cancellation petition to the appropriate trademark office or administrative body. Follow their specific filing procedures, which may include completing application forms, paying filing fees, and submitting the required documentation.
A petition for cancellation of a trademark registration may be filed at any time. However, a mark which has been registered for more than five years may only be cancelled on the grounds enumerated in Trademark Act 14.
Abandonment or Non-Use: If a court agrees that the trademark is not being used with any of the goods or services listed in the trademark application, the application can be declared void ab initio, and the trademark registration may be canceled.
A trademark can be invalidated (revoked) five years after registration by a third party if the party can prove the trademark is not being used for the registered purposes.
