Can you cancel your own trademark?

A petition for cancellation of a trademark registration may be filed at any time. However, a mark which has been registered for more than five years may only be cancelled on the grounds enumerated in Trademark Act 14.

How do you invalidate a registered trademark?

Simply, to file a Petition to Cancel with the TTAB, one must state the his/her interest in the case, the cause to action of the case (why the mark deserves to be canceled) and pay the required fee.

How do you reset a trademark?

If your trademark has fallen into dead or abandoned status unintentionally, you may petition the USPTO within 60 days of the Notice of Abandonment. After the 60 days have lapsed, or if you cannot document the abandonment was unintentional, you will need to file a trademark application with the USPTO.

Can you withdraw a trademark?

However, there may be negative consequences to taking this action. Keep in mind that typically a trademark applicant can abandon his trademark rights in an application by filing an express abandonment.

How do I remove a trademark?

If the mark has already been placed on the Principal Register, the party may petition the USPTO for cancellation of the registration. (15 United States Code, Section 1064.) A cancellation petition may be filed: within five years from the date the mark is published in the Official Gazette.

How to prove trademark abandonment?

It is much easier to prove abandonment if there has been three years of nonuse, so that the presumption attaches. If there isnt three years of consecutive nonuse, then the burden remains with the party bringing the claim to show nonuse and lack of intent to resume use by a preponderance of evidence.
