The Freedom of Information Act (FOIA) gives any person the right to request access to records of the Executive Branch of the United States Government. The records requested must be disclosed unless they are protected by one or more of the exempt categories of information found in the FOIA.
A crucial aspect of qualifying for a fee waiver is the relationship of the information to public understanding of the operations or activities of government. Another important factor is the ability of the requester to convey that information to other interested members of the public.
The Departments bureaus and offices are authorized to charge fees to requesters in order to recover the direct costs of search, review and duplication of requested records. If the total costs of supplying the requested information is less than $50, the Department will waive any applicable fees.
Note: An important factor taken into consideration is the requesters identity and qualifications -- e.g., expertise in the subject area and ability and intention to disseminate the information to the general public is evaluation.
For Form N-400, Application for Naturalization, the fee rule makes the following changes: As of April 1, 2024, the standard fee for filing is $760 for a paper filing of the N-400. Any applicant who seeks a reduced fee or a full fee waiver must file on paper. Under the 2024 fee rule, there is no separate biometrics fee.
What are FOIA exemptions? Not all records are required to be released under the FOIA. Congress established nine exemptions from disclosure for certain categories of information to protect against certain harms, such as an invasion of personal privacy, or harm to law enforcement investigations.
USCIS fee waivers continue to be based on three criteria: Receipt of a means-tested benefit; Household income at or below 150% of the FPG; or. Extreme financial hardship.
FinCEN may waive or reduce fees if it is determined that disclosure of the records is in the public interest because it is likely to contribute docHubly to public understanding of the operations or activities of the government and is not primarily in the commercial interest of the requester.
