What is a kick out clause and how does it work? A kick out clause is called that because it allows a seller to continue showing the house for sale and to kick out the buyer if the seller receives an offer from another buyer without a home sale contingency. Generally, this is how a kick out clause works.
Heres an example: Lets say a buyer puts down an offer for $160,000 on a home and another buyer comes along a week later and offers $190,000 instead. If a 72-hour clause has been written into the contract, the original buyer now has 72 hours to make a better offer than $190,000.
A kick-out clause is a provision in a homes sales contract that allows sellers to accept a contingency while still showing their home in hopes of receiving a non-contingent offer.
Without the clause, the seller has no power and theres no way to get that buyer out. Typically, Pardees clauses give the first buyer 24, 48, or 72 hours to drop the contingency and proceed with the sale; if they cant perform within that time, the seller can kick them out of escrow.
The 72 hour clause is usually written into sales contracts by the seller, this allows a seller to keep the home on the market and accept backup offers on the property during. This clause is also commonly known as the escape clause, release clause, kick-out clause, hedge cause or right of first refusal clause.
It applies when someone has made a contingent offer to buy the house. The kick-out clause says that the seller can continue showing the home and can accept a new offer that comes without contingencies, effectively kicking out the contingent offer if a stronger one comes along.
The out clause typically requires the party seeking to terminate the contract to provide written notice to the other party, outlining the reasons for the termination. After receiving the notice of termination, the other party may have an opportunity to cure any deficiencies and avoid the termination of the agreement.
The kick-out clause would generally give the first buyer a specified period (e.g., 72 hours) to either: Remove their sale-of-home contingency and move forward with the purchase, showing they have the means to complete the purchase without selling their existing home.
