Anti-contest clauses (also known as in terrorem clauses, contest clauses, no-contest clauses, noncontest clauses, and forfeiture clauses) are clauses in a will that impose a condition upon a devisee or legatee that they will not dispute the provisions of a will.
A disaster clause in a Will is simply a clause which provides who will get your estate if all of the named beneficiaries in your Will do not survive you.
Under the common disaster provision, a certain period of time is designated so that, even though both the insured and the beneficiary died as a result of the same accident, it is possible to determine that the beneficiary died last and policy disbursements would be distributed ingly.
A wipeout clause is a clause that specifies who assets go to if none of your immediate family / named beneficiaries survive. That is, you can leave assets to a spouse and kids, or specific assets to specific individuals.
The common disaster clause states that the primary beneficiary must survive the insured by (usually 30-90 days) or the benefit is automatically paid to the secondary beneficiary.
The words all the rest and remainder signifies that any assets not otherwise bequeathed are to be given to the person or entity listed. There are various effective ways to state a residuary clause, but the key is to clearly express that what is left over is to be given to some person(s) or organization(s).
Its purpose is to establish an order of succession or alternative beneficiaries in case the primary beneficiary is unable to receive the policy benefits due to their simultaneous death with the insured.
Examples of Common Disaster Clauses in Wills Specifying Survivor: In the will of John and Mary Smith, a common disaster clause stated that if both died in a common disaster, Mary would be considered to have survived John.
