After someone dies, Maryland law does not provide a precise time limit or deadline for filing the deceased persons will with the Register of Wills. However, the person who has the individuals will, or the person who finds the will, must file it promptly after the person dies.
A will is a written document directing the disposition of a persons assets after death. In Maryland, a will must be (1) in writing (typed or handwritten), (2) signed by the person making the will, and (3) attested and signed by two credible witnesses in the presence of the person making the will.
Without a will, the intestate laws of the State of Maryland direct the order of priority for those individuals to serve as personal representative of the estate; what heirs are entitled to receive the assets of the estate; and in some instances the Orphans Court shall make the appointment of a guardian for your minor
Maryland Law requires that any one holding an original Will and/or Codicil(s) must file that document with the Register of Wills promptly after a decedents death even if there are no assets. However, although the Will and/or Codicil are kept on file, no probate proceedings are required to be opened.
A show cause order directs a person to show cause on or before a specified date why the court should not take the action described in the order. If a hearing is scheduled when the order is signed, the order shall set forth the date and time. The order shall also specify who is to be served and the method of service.
