Double jeopardy is a common concept in criminal law in civil law, a similar concept is that of res judicata. The double jeopardy protection in criminal prosecutions bars only an identical prosecution for the same offence; however, a different offence may be charged on identical evidence at a second trial.
However, previous evidence can be utilized. Also, judges hold the authority to grant or deny a trial de novo. In a trial de novo, the case is retried with the presence of a bench trial, depending on what the court decides.
Prior Testimony evidence given in a prior proceeding by a witness is admissible for its truth in a later proceeding provided: a. the witness is unavailable; b. the parties are substantially the same; c. the material issues to which the evidence relates are substantially the same; and, d.
Because discovery is often long and expensive, many courts find that allowing the use of discovered information in later cases through the terms of a protective order is an effective way to speed up the process and minimize costs in future cases.
The former testimony exception allows the previous testimony of a witness to be admissible in a second proceeding as an exemption to the hearsay rule under the Federal Rules of Evidence. The declarant is unavailable to testify in the second proceeding.
The primary role of the BER is merely to be an adjunct to authenticity that assures the court that the document is the same as the one inputted into the computer. The rule excludes inferior evidence when better is available and permit inferior evidence when better is not available.
Therefore if, in the course of a criminal investigation, the police violate the accuseds Charter rights to obtain evidence, the accused may have a remedy against the police and the evidence may be inadmissible in a proceeding against him or her.
Hearsay describes any statement (oral or written) that is made out of court; and led in Court to try to prove what was said or written is true. Hearsay is generally not admissible as evidence in trial, but may be admissible in some chambers hearings (see Chambers Applications).
The exclusionary rule, which provides that illegally obtained evidence or the fruits of that evidence may not be admitted into evidence in trial proceedings,1 has not received the same broad acceptance in administrative cases that it has in criminal proceedings.
It is evidence excluded from consideration during the trial or any other legal proceedings. Inadmissible evidence is typically not allowed due to factors such as lack of relevance, violation of constitutional rights, hearsay, or improper collection methods.
