Ending the Rental Agreement For example, in most cases a six month rental agreement cannot be ended until the six months are up. To end a month-to-month agreement, written notice must be given at least 30 days before the next time rent is due (not including any grace period).
The Act allows a landlord to give a tenant notice to end the tenancy early if the tenant, the tenants guest or someone else who lives in the rental unit does something they should not do, or does not do something they should. This is sometimes called ending a tenancy for cause.
Whichever party wants to terminate the lease must provide no less than 30 days written notice to the other party of their intent to end the lease. In many cases, tenants wishing to terminate early must pay an early termination fee, which usually amounts to one months rent.
If you fail to make a periodic payment, you will be in default. Default means that the RTO contract has ended, and that you are not entitled to use or keep the rental property. However, you may be able to reinstate the contract, as described in this section.
Once you sign the lease, you cannot change your mind later. If the tenant changes his or her mind and decides not to move into the unit after signing the lease, the landlord can impose early termination penalties if provided in the lease.
You should ask open-ended questions and show empathy and respect for their situation. For example, you can ask them why they want to move in earlier or later, what are their main concerns, and how flexible they are. You should also share your own perspective and explain the benefits and drawbacks of different options.
When a landlord and tenant sign a lease agreement it forms a legally binding contract. The lease cannot be altered except through another written agreement signed by both parties unless the original lease specifically gives a party the power to change something on their own.
Unfortunately, there is no cooling off period with respect to lease agreements. They are legally-binding contracts, once signed. The good news for you is that ing the Residential Tenancy Act, leases do not come into effect until the start of the lease (ie the move-in date).
