In short, the distinction between the two forms of warranty deeds is that in a general warranty deed, the seller warrants against anything any owner of the property ever did to encumber title and in a special warranty deed the seller only warrants against anything the seller did to encumber title.
A Colorado special warranty deed is a recorded instrument that transfers real estate with limited warranty of title. A warranty of title is an enforceable promise from the propertys current ownerthe grantorto the new ownerthe granteethat the propertys title is free of defects.
A general warranty deed is used to transfer real property from one person to another. This type of deed offers the greatest protection for the buyer and has specific requirements for what must be included in the document.
There are up to six express covenants that may be found in a deed: the covenant of seisin, the covenant of the right to convey, the covenant against encumbrances, the covenant of quiet enjoyment, the covenant of general warranty, and the covenant of further assurances.
in general warranty deed, the promises made by the grantee only apply to events that occurred during the grantees ownership of the property. C. in a special warranty deed, the promises made by the grantor only apply to events that occurred during the grantors ownership of the property.
What is a Warranty Deed? A warranty deed (sometimes called a general warranty deed) is a form of deed that provides a full guarantee of title to real estate. This guarantee covers acts taken by all previous owners in the chain of title.
A special warranty deed guarantees that the buyer wont face any legal action or title issues as a result of the actions of the propertys previous owner. A downfall is that this type of deed does not offer any guarantees that prior owners owned the property free and clear.
A Warranty Deed is the best of the best. It protects you from all future and past issues with property title and any outstanding debts or liens.
The Special Warranty Deed is similar to the Statutory Warranty Deed. It has the same five covenants of title in addition to fee simple title. However, unlike the Statutory Warranty Deed, the Special Warranty Deed only includes the time period that the seller had the property.
However, unlike a general warranty deed, a special warranty deed provides these covenants only as to the time period during which the seller owned the property. In other words, a special warranty deed only guarantees that no title issues arose during the time that the prior owner owned the property.
