A void contract is a promise that the law wont enforce. Imagine a person who isnt the actual owner of a property trying to sell a property they dont own. If someone tries to sell a house they dont own, thats likely an example of a void contract. In these cases, the law assumes that the contract never existed.
These are some of the most common reasons: The subject of the contract is illegal. The terms are vague or impossible to fulfill. Lack of consideration. Fraud.
For example, remember that blue house you wanted to buy? Well, you signed a contract for a blue house, but now you show up and the house is green! This is VOIDABLE, not VOID! That is because the violation of the contract should not stop you from being able to buy the house.
One or both parties, change their mind about the agreement. One party was duped, pressured, or misled into signing the contract and uses their right to challenge its legality. One or both parties decide to rescind the consent. The contract was established under duress, fraud, deception, or coercion, making it voidable.
A contract is unenforceable when there is evidence of lack of capacity, coercion, undue influence, misrepresentation/nondisclosure, unconscionability, violation of public policy, or impossibility.
Void is a legal classification. To say that a contract is void means that it does not fulfill the requirements of a valid contract, it is not legally binding or enforceable. A contract that is void in one that is missing any one of the essential elements that make a contract binding. ( see Valid)
Lack of capacity: If a party to the contract cannot understand the contract, such as a minor or person under the influence of alcohol, the contract may be void. Lack of assent: Contracts must have a genuine agreement. If a contract is formed under duress or threats, undue influence, or fraud, its generally void.
A contract which provides to do an impossible act is void. It will also be void when it becomes impossible to do an act stated in the contract due to the occurrence of an event beyond the control of the party.
