For the holder of a patent, an invalidation can mean forfeiting all rights to their invention or products. They will no longer be able to benefit from the exclusive rights that come with a valid patent, such as preventing others from copying or profiting from their invention.
In IPRs and PGRs, anyone except the patent owner can file a petition to challenge the patent. IPR offers a limited procedure for patent invalidation. The USPTO filing fees for IPR, and PGR are high $41,500 for an IPR and $47,500 for a PGR.

When a patent is invalidated, it means that the patent is no longer legally valid and enforceable. This can have various consequences for the holder of the patent and any other parties involved in the matter. For the holder of a patent, an invalidation can mean forfeiting all rights to their invention or products.
If the accused manufactured, sold, attempted to sell, or imported the invention without permission, a direct infringement occurs. If the accused actively induces a third party to manufacture, sell, attempt to sell, or import the invention without permission, indirect infringement (contributory infringement) occurs.
During the proceedings for impeachment, it is the responsibility of the interested person to prove that the patent or one or more of its claims are void. Many reasons may be invoked in an attempt to invalidate a patent, either based on prior art or on technical reasons linked to intrinsic defects in the patent.
