Does copyright law protect typefaces and fonts? Generally, copyright law in the U.S. does not protect typefaces. Fonts may be protected as long as the font qualifies as computer software or a program (in fact, most fonts are programs or software).
If a font is not used to brand a product, then it cannot be trademarked and will not receive any protection from trademark law. This is why most fonts are not trademarked they are simply not used in a way that would make them eligible for trademark protection.
Fonts can be free or licensed, for a fee, for commercial use. Whether you pay for a font or acquire it for free, each font comes with a license explaining how you may use it (and how you may not use it). The End User License Agreement (EULA) defines your rights and obligations.
Font licensing is getting permission from a font creator or distributor to use a particular font in a certain way. Some fonts require you pay a fee to obtain certain usage rights, which involves purchasing the license, while others are free.
Typefaces, fonts, and their glyphs raise intellectual property considerations in copyright, trademark, design patent, and related laws. The copyright status of a typeface and of any font file that describes it digitally varies between jurisdictions.
There can be legal consequences for failing to comply with font licensing this includes financial penalties and the removal of the infringing fonts. One notable instance of font law in practise was a lawsuit against NBC Universal by Font Bureau for use of one of their fonts without proper licensing.
Copies made in any format are covered by copyright. LITERARY works such as books, pamphlets, computer programs and other works consisting of text. This includes fonts, which are computer renderings of typeface made available through software (which is written code).
If a company uses a font without the permission of the owner of that font, or outside of the scope of that companys license, that company could be subject to a claim of copyright infringement.
