Having no legal effect from the start. Thus, a void contract is invalid from the start of its purported closing (having no legal effect, it does not change the legal relationship between the parties involved).
The void contract has been defined under section 2(j) of the Indian contracts act, 1872. A void contract was once a valid contract, but it has become void now due to changes in some of the original conditions. There is no obligation or rights concept in a void contract and is not enforceable by either the parties.
Simultaneously, Section 2(j) states that a contract becomes void when it ceases to be enforceable by law. Along with these, Section 20 deals with void contracts if parties mistake the matter or essential facts of a contract. Also, sections 24, 25, 26, 27, 28, 29, 30, and 56 deal with void agreements.
In law, void means of no legal effect. An action, document, or transaction which is void is of no legal effect whatsoever: an absolute nullitythe law treats it as if it had never existed or happened.
Void Contract Example: Forced Consent Suppose Party A enters into a contract to sell their car to Party B. However, Party B threatens physical harm to Party A if they do not agree to the sale. In this situation, the contract is void as Party As consent was obtained through force.
A contract will be void where: the parties contract on the basis of a fundamental common mistake. one party contracts on mistaken terms and the other party knows of the mistake. one party is mistaken as to the other partys identity. a party executes a document under a fundamental misapprehension as to its nature.
Rescission is the voiding of a contract that a court does not recognize as legally binding.
