The best solution is to settle pet custody outside of court, and to come to a mutual decision together. It is best if you and your ex can agree on a mutually satisfying arrangement. If you both want the dog, be open-minded. You may decide that the dog should live with you during the work week and spend weekends with your ex. Or, you may decide that the dog is best off with you, and your ex can schedule doggy visits.
Putting a Pet First Courts now have a much clearer direction and will award custody of a pet based on what is deemed best for the animal. Theyre also able to create shared custody agreements and may enter orders that require one party to care for a pet prior to final ownership determination.
Although many people consider their pets to be members of the family, the Court treats animals as personal belongings or chattels on divorce and will simply look to the legal ownership of the animal when deciding who the pets should be with.
The idea of sharing a dog can seem like the best way to avoid the anguish of saying goodbye to a dog, but not all dogs are able to cope well with a life split between two homes. It is rarely the best option for a dog, although many do learn to live with it.
