A DPOA allows an individual, known as the agent, to act on behalf of another person when they are incapacitated or, in some cases, immediately upon signing. The DPOA can be effective from the moment it is signed or only after the person becomes incapacitated. Historically, agents could only act if the principal had the mental capacity, but a durable power of attorney allows the agent to continue functioning on the principal's behalf even if they lose their mental capacity. This provides essential flexibility in managing affairs during incapacitation.
