- Lets talk about whether or not a brand owner can change a trademark. And shout-out, this question comes from Tim Carr on Twitter. And if you have topics youd like to see covered in future videos or podcasts please Tweet at me, @tmforsmallbiz and Ill try to get to as many of them as I can. So brands often evolve over time and sometimes brand names or logos do change or evolve. Sometimes the changes are subtle like Coke at one point was evolving into New Coke. Sometimes theyre more dramatic when a brand shifts its name entirely or when two companies merge and Exxon becomes ExxonMobil, for example. So brand names do evolve over time. But what I wanna talk about now is trademark filings and whether or not the marks in those filings can change. And the answer is generally no. So when a trademark application has been filed at the USPTO or registered at the USPTO, generally only very, very small changes will be allowed. If the change amounts to whats called a material alteration, which

The U.S. Patent and Trademark Office accepts applications for trademark registration in two formats, a standard character format and a design or stylized format.
A specimen for a trademark used on goods shows the mark on the actual goods or packaging for the goods. For example, a tag or label for the goods, a container/packaging for the goods, a display associated with the goods, or a photograph of the goods are examples of trademark specimens.
Prior to November 2, 2003, standard character drawings were known as typed drawings. The mark on a typed drawing had to be typed entirely in capital letters. A typed mark is the legal equivalent of a standard character mark.
SPECIAL FORMAT TRADEMARKS Special format marks, unlike standard character marks, allow for additional characteristics to be claimed in the mark, including color, unique lettering style, elements of design, and also uncommon punctuation.
How to Trademark a Slogan Go to the United States Patent and Trademark Office (USPTO) website. Check the Trademark Electronic Search System (TESS) database. Make sure the slogan isnt already registered in the same category. Submit your trademark application. Pay the filing fee.
Marks comprising only a design are coded as mark drawing code 2; marks comprising words plus a design are coded as mark drawing code 3; and marks comprising stylized letters and/or numerals with no design feature are coded as mark drawing code 5.
The compound words need to be disclaimed. While registering the trademark, a compressed compound word has to be separated in the disclaimer. For example, in the mark KATES COOLPACK.COM related to insulated containers, the disclaimed terms would be COOLPACK.COM.
For example, a specimen could be an advertisement, brochure, website printout or other promotional material which shows your trademark used for the services, business signs where the services are rendered showing your trademark, or a service vehicle showing your trademark.
