hey whats up everybody this is attorney dan and today i want to talk about trademarks and if you can transfer your trademark to another party and the answer is yes this is the united states patent and trademark office uh regard a website regarding trademark assignments or transferring ownership or changing your name okay and so um one thing to understand is if you if you are filing on a 1a basis which is at actual use spaces but have not received your registration you can still transfer your application to another party now if you are applying under a 1b intent to use unfortunately you cannot transfer your application to another party um you uh the other party um you essentially would have to uh um abandon your application and then the other party would um uh would have to a form or apply on their own so you cant transfer a an intent to use uh application but this page will tell you how to do it right the you um there should be a trademark assignment form that you sign between the tw

Trademark Invalidation If the registration is less than five years old, the party challenging the trademark rights can rely on any ground that could have prevented registration initially. The likelihood of confusion and descriptiveness is the most common grounds asserted to invalidate trademark rights.
You can modify the trademark youre using on your products and services, but you cannot modify an existing registration, so unless you register your newly modified trademark, it will not have the same scope of protection as a prior, unmodified, registered trademark.
However, if the two products are not related to one another and not likely to cause any confusion, then trademark law will not prevent the two companies from using the same name. Put differently, if the same name is registered in different trademark classes, this does not give rise to an infringement claim.
If trademarks share a common word or term, the marks may be considered similar in appearance even if one of the marks adds other letters or another word to it, especially if the added material is descriptive or suggestive of the goods or services.
