To regain possession of a property with tenants under an Assured Shorthold Tenancy (AST), serve a written notice at least two months prior to the end of the 12-month fixed term. You cannot ask tenants to leave during the fixed term, as they have a legally binding contract. A Section 21 notice should be issued, specifying the end of the tenancy on the last day of the fixed term.
