An amendment is typically used to change something thats part of an original contract. Think of amendments as modifications to the earliest agreement (for example, altering an agreed-upon deadline). An addendum is used to clarify and add things that were not initially part of the original contract or agreement.
Both parties must agree to, draw up, and sign an addendum for it to be legally recognized.
Lease addendums must be signed by all parties, just like the lease agreement, in order to be legally binding. If the tenant refuses to sign, the addendum is not considered valid or legal because they have not agreed to the changes.
A contract amendment is a change, correction, clarification, or deletion to an agreement you have already signed. An amendment leaves your original agreement substantially intact.
Writing a Contract Addendum Name the parties to the contract. Indicate the addendums effective date, using the same date format used in the original contract. Indicate the elements of the original contract that the addendum intends to change. Concisely but clearly describe the desired changes.
Always put a contract amendment in writing and make sure both parties sign and date it. Reference the title of the contract, if applicable; its original parties; and original signing date, so that it is clear what document you are amending. Attach the amendment to the original contract.
The language in the addendum has the ability to override the original terms of the agreement. Any addendums that are attached can be very powerful. This is because they will override the language that was in the contract before the addendum was attached.
A contract addendum is a post-contract attachment that modifies, alters, or totally changes some of the terms of a previously established contract. Typically, this adds something new to a preexisting document. Once all parties named in a contract agree to an addendum, it becomes a part of the new contract.
