Inability to Enforce Rights: An expired trademark typically means the owner loses the ability to enforce their trademark rights against others using a confusingly similar mark. This situation allows other businesses to use the same or similar mark without facing trademark infringement claims.
Within two months of the date of the cancellation/expiration notice, the registration owner must file a petition to revive with all the necessary requirements and fees. If more than two months have passed since the USPTO cancellation notice, a trademark owner will need to file a new application for the same mark.
Some companies file for a trademark on a logo or slogan and then never use them. Other times, the iconography is too similar to other existing trademarks. In these scenarios, the United States Patent and Trademarks Office (USPTO) may deem a trademark invalid and revoke it.
There are several legal grounds that exist to cancel a trademark registration, including priority, abandonment (by non-use of at least three consecutive years together with an intent not to resume use), and fraud. There are additional grounds as well, such as priority of use and genericness.
A canceled trademark is a trademark that, for one reason or another, has been deemed invalid. When a trademarks registration has been terminated, that means it can be registered by another person or business. It also means the trademark cannot be used in any way to deny the registration of a similar trademark.
To claim the dead trademark you will need to complete an application with the USPTO. Provide your name and address, the name of the dead mark, a statement as to the goods and services that you wish to sell under the mark and a statement as to whether you have attempted to register the mark previously.
File a Request for Reinstatement form. File your request for reinstatement no later than two months after the issue date of your Notice of Abandonment. If you didnt receive a Notice of Abandonment, file within two months of learning of the abandonment, but no later than six months after the abandonment date in TSDR.
