In a criminal proceeding, the admission of evidence is governed by the rules of evidence, just like in a civil trial. For example, hearsay, or out-of-court statements used to prove the truth of the matter asserted, is not admissible unless it meets one of the limited exceptions to this rule.
For instance, if an eyewitness sees an incident in poor lighting or from a distance, his or her recollections are less likely to reliable. A persons biases can affect the accuracy of his or her memories, and so can stress factors, such as the presence of a gun during an assault or violent crime.
What Makes Evidence Inadmissible? Lack of relevance: If the evidence does not directly affect the facts, it will likely be excluded. Hearsay: Generally, hearsay, which refers to an out-of-court statement offered as truth by a witness not testifying in the case, is not allowed.
You can object if you think the other sides evidence, witness testimony, or question should not be allowed. The rules for what is allowed in court are in the evidence code. If a judge agrees with your objection, the evidence or testimony wont be part of the official court record and cant be used to decide your case.
Under certain circumstances, relevant evidence will be inadmissible if its probative value is substantially outweighed by the danger of unfair prejudice, confusing the issues, misleading the jury, undue delay, wasting time, or needlessly presenting cumulative.
