The Four Types of Trademarks Generic. Descriptive. Suggestive. Arbitrary or Fanciful.
A phrase, word, symbol, device, or even a color are all eligible for a trademark. Anything that distinguishes the goods of your party or company from another qualifies.
Some of the most widely recognized and famous trademarks include: Google. Walmart. Vodafone. Rolex. Clorox. Kodak. Exxon. Victoria Secret.
A trademark offers legal protection for a word, symbol, phrase, logo, design, or combination of those that represents a source of goods or services. Types of trademarks for products include five main categories: generic mark, descriptive mark, suggestive mark, fanciful, and arbitrary mark.
A common law trademark is a trademark established solely through use in commerce in a specific geographical area. Business names, logos, and phrases that are regularly usedeven though they have never been federally registeredcan all be considered common law trademarks.
The trademark assignment document must be signed by the assignor or owner of the trademark in favor of the assignee or the new owner receiving the property rights over the trademark. Thereafter, the trademark assignment must be recorded with the Trademarks Office to reflect the new ownership.
For example: X is the proprietor of brand ABC. X assigns his trademark ABC completely through an agreement to Y. After this, X will not have any rights with respect to the brand ABC. The trademark proprietor assigns the trademark to another person with respect to only specific services or goods.
Selecting a legally strong trademark is as simple as following these simple rules. Avoid Trademarks that cannot be Registered. Avoid Surnames. Avoid Confusing Trademarks. Avoid Purely Descriptive Words. Avoid Generic Words in a Trade mark. Avoid TLAs (Three Letter Acronyms) and Numbers. Use animal or plant names.
Under trademark assignment without goodwill, the assignor restricts the assignee from operating in the market where the assignor is already active. The assignee is permitted to use the same trademark but not for identical services/services as the assignor.
Assignment means transferring rights, interests, titles and benefits from one person to another. Assignment of a trademark means to transfer the owners right in a trademark to another person. The transferring party is called the assignor, and the receiving party is called the assignee.
