Landlords often question if it's wise to serve a notice to vacate in December. While getting a trial setting before Christmas is unlikely, it may be necessary to regain your property in January. Even if it goes to trial, you won't recover your property until January. Trying to resolve issues with tenants during the holiday season is advisable, but initiating the process now won't harm you, given the timeframe for property retrieval.

In residential tenancies, you must be given at least two months notice. In rooming accommodation, you must be given at least 30 days notice. You can be given this notice whether you have a periodic agreement or a fixed term agreement.
If the landlord did not set out a specific end date, there might be a tenancy-at-will. If there is a tenancy-at-will, the landlord must give the tenant sixty (60) days notice telling them to leave.
In California, landlords must file a 60 or 30-day notice to vacate letter before moving forward with an eviction. The notice of termination gives their tenant time to move out or deal with a dispute. If the tenant doesnt vacate the property after this time, landlords may start the eviction process.
A landlord can use a 30 day-notice to end a month-to-month tenancy if the tenant has been renting for less than a year. A landlord should use a 60-day notice if the tenant has been renting for more than one year and the landlord wants the tenant to move out. (CCP Section 1946.1.)
Intention to leave is considered a conscious and deliberate desire to leave an organization within the near future and considered the last part of a sequence in the withdrawal cognition process (Mobley et al., 1978).
In Georgia, you can be evicted if you do not pay rent, if you break an important part of your lease, or if your lease expired. However, your landlord cannot make you move without a court order. Evictions are called dispossessory actions.
If the tenant has been there for less than a year paying on a month to month basis and you want to terminate their tenancy, a 30 Day Notice to Vacate is the correct form to serve. If the tenant has been there for over a year, a 60 Day Notice to Vacate is the eviction notice you want to serve.
Georgia law says that a landlord cannot make a tenant make or pay for repairs, unless that tenant, his/her family or guests caused the damage. For serious repair problems, local housing code departments can inspect for possible violations.
Because there is not a written lease, Georgia law regulates the type of notice which a tenantatwill and the landlord of the tenantatwill must give to terminate or change the original rental agreement. A tenant must give thirty (30) days notice to the landlord to terminate or change the original agreement.
Under the terms of your lease, you are legally required to provide a minimum of 21 days notice in writing. Failure to give the required notice, will result in rent continuing to be charged for the full 21 days.
