A deed of trust involves three parties: a lender, a borrower, and a trustee. The lender gives the borrower money. In exchange, the borrower gives the lender one or more promissory notes. As security for the promissory notes, the borrower transfers a real property interest to a third-party trustee.
A trustee deedsometimes called a deed of trust or a trust deedis a legal document created when someone purchases real estate in a trust deed state, such as California (check your local laws to see what is required in your state). A trust deed is used in place of a mortgage.
A Trustee is considered the legal owner of all assets determined by the trust document. Trustees can have a legal say, for example, if a trust beneficiary is occupying a trust property.
In simple terms, anyone who has the capacity to hold property can be a trustee. It is possible to be both a beneficiary and a trustee, although this may not always be appropriate. A trust may have just professional trustees, just lay trustees or a combination of the two.
A deed of trust is an agreement between a home buyer and a lender at the closing of a property. The agreement states that the home buyer will repay the home loan and the mortgage lender will hold the propertys legal title until the loan is paid in full.

With a mortgage, the lender interacts directly with the borrower in this process. With a deed of trust, however, the lender must act through a go-between called the trustee. The beneficiary and the trustee cant be the same person or entity.
The Trustor is the person who borrowed the money (the Payor of the Note) The Beneficiary is the person who is lending the money (the Payee of the Note) The Trustee is the neutral 3rd party who will issue the release of the loan once it is paid in full.
The trustee named in a Texas deed of trust can be any individual person who has the legal capacity to hold and transfer property. Under Texas law, if the named trustee is a corporation, the corporation must be authorized to act as a trustee in Texas.
This document may be called the Security Instrument, Deed of Trust, or Mortgage. When you sign this document, you are giving the lender the right to take your property by foreclosure if you fail to pay your mortgage ing to the terms youve agreed to.
