A common example of tacking is as follows: First legal mortgage is advanced to “A” and then a second (equitable) mortgage is advanced to “B”. “A” later advances further money to the owner on security of the same property.
In cases like these -- where subsequent parties in the same position to the land continue to use the right of way adversely -- the time adds together to meet the required time period for adverse possession. This situation is known as "tacking". Thus, a prescriptive easement doesn't need to be exclusive.
Color of title refers to a claim based on a land right, land warrant, land scrip or an irregular chain of title “that does not want of intrinsic fairness or honesty.” Thereafter, the owner fails to file suit to recover the property within three years.
In Tennessee, there is a second (though rare) way that a trespasser can gain adverse possession over someone's property. "Color of title" is a legal phrase meaning that there is a legally filed document that gives the appearance of actual legal title, but that this document is not legally valid.
Adverse possession is a doctrine under which a person in possession of land owned by someone else may acquire valid title to it, so long as certain requirements are met, and the adverse possessor is in possession for a sufficient period of time, as defined by a statute of limitations.
The importance of a possession is based on the meaning attached to the item by the owner. Possessions have a private meaning in that they are used "...as markers to remind ourselves who we are" (Wallendorf and Arnould 1988, p. 531).
Thus, possession tends to be regarded as prima facie evidence of the right of ownership; it gives this right against everyone except the rightful owner. Mere possession by a finder is sufficient to provide grounds for an action against one who deprives him of the object with no better right than his own.
Adverse possession is a legal doctrine that allows a person to claim a property right in land owned by another. Common examples of adverse possession include continuous use of a private road or driveway or agricultural development of an unused parcel of land.
In order to make a claim for adverse possession, you must be able to demonstrate the following: factual possession of the land; an intention to possess the land; and. that the possession has been without the consent of the owner.
