The Personal Information Protection Act (PIPA), Md. Code Ann. Com​m. Law 14-3504​, was enacted to make sure that Maryland consumers personal identifying information is reasonably protected, and if it is compromised, they are notified so that they can take steps to protect themselves.
Federal data privacy laws The U.S. does not yet have a comprehensive federal consumer data protection law that covers all varieties of private data. But it does have several federal laws that protect specific data sets, such as the U.S. Privacy Act of 1974, HIPAA, COPPA, and the Gramm-Leach-Bliley Act.
Marylands privacy law includes heightened data minimization requirements for sensitive data. Controllers can only collect, process or share sensitive data when it is strictly necessary to provide or maintain a requested product or service, and Marylands privacy law prohibits selling sensitive data entirely.
The Maryland Online Data Privacy Act of 2024 (MODPA) requires stricter protections for sensitive data and offers opt-outs from targeted advertisements and the sale of personal data.
Senate Bill 397 (2020) provides for a sales and use tax exemption on qualifying data center personal property that is purchased or leased for use in a data center that is located within the State of Maryland and meets certain capital investment and new job requirements.
Maryland privacy law is subject to certain statutory exemptions resembling other US privacy laws.
