The OSHA office is required to respond to all complaints. One of their options is to send a Fix and Fax letter to the employer detailing the hazard reported and requesting information such as company policies and/or procedures related to the hazard.
When the OSHA compliance officer arrives, the company guard or receptionist should immediately escort the inspector to a comfortable waiting area and alert the pre-designated personnel of the inspectors arrival. First impressions are important. Dont keep the OSHA compliance officer waiting for longer than necessary.
Generally, OSHA inspections concentrate on the most hazardous sites found in the workplace. Complaints from employees and referrals from agencies, organizations or the media also receive elevated attention. Workplaces with ten or fewer employees are exempt from random inspections by federal OSHA officials.
When an inspector finds violations of OSHA standards or serious hazards, OSHA may issue citations and fines. OSHA must issue a citation and proposed penalty within six months of the violations occurrence.
Normally, OSHA conducts inspections without advance notice. Employers have the right to require compliance officers to obtain an inspection warrant before entering the worksite. During the walkaround, compliance officers may point out some apparent violations that can be corrected immediately.
The inspection includes an opening conference, a walkaround of all or part of the workplace, and a closing conference. This may take a few hours or several weeks, depending on the number of hazards, workplace size, and other factors. Take notes throughout the process.
Its important to understand that OSHA has up to 6 months to issue citations once the initial inspection is completed. In most cases, citations will be mailed and issued within 1-2 months of the inspection, but weve seen citations arrive during the 5th month too, right up against the 6 month deadline.
