- Hey everyone, my name is Paul Vojchehoske and welcome to the Real Estate Classroom YouTube channel. Before we get started, please do me a favor. Give this video a thumbs up, hit that red subscribe button and click on the notification bell. In todays video were gonna discuss whats called a deed of trust, or sometimes called a trust deed, depending on what part of the country youre operating in. Now, I did a previous video on, excuse me, the promissory note and a mortgage. A promissory note, the mortgage, and a deed of trust all kinda go hand in hand together. So if you have not watched that video yet, I highly recommend that you go watch that video first, then come back to this one. That will make this video make so much more sense. And Im gonna put a link right up here in the upper right hand corner of your screen to that video. So thats my recommendation. All right, so are you ready? Lets talk about deeds of trust in this video. (upbeat music) So what is a deed of trust? Wel

Generally, the trustee must be an attorney, title insurance company, trust company, bank, savings and loan, credit union, or other company specifically authorized by law to serve as a trustee.
A deed of trust is an agreement between a home buyer and a lender at the closing of a property. The agreement states that the home buyer will repay the home loan and the mortgage lender will hold the propertys legal title until the loan is paid in full.
There are two basic types of Deeds of Trust, the Long Form and the Short Form. The Long Form, which could be 20-30 pages long, is the one used by institutional lenders. The Short Form is the one that is most usually prepared by your Escrow Officer.
Both a warranty deed and deed of trust are used to transfer the title of a property from one person to another. However, the difference between these two contracts is who is protected. As you now know, a deed of trust protects the beneficiary (lender). A warranty deed, on the other hand, protects the property owner.
Trustees. The trustees are the legal owners of the assets held in a trust. Their role is to: deal with the assets ing to the settlors wishes, as set out in the trust deed or their will.
The Trustor is the person who borrowed the money (the Payor of the Note) The Beneficiary is the person who is lending the money (the Payee of the Note) The Trustee is the neutral 3rd party who will issue the release of the loan once it is paid in full.
Deed of Trust Versus Promissory Note A deed of trust often requires a promissory note, but the promissory note is a specific document type. While a deed of trust describes the terms of debt as secured by a property, a promissory note acts as a promise that the borrower will pay the debt.
With a deed of trust, the lender gives the borrower the funds to make the purchase. The borrower provides the lender with a promissory note. The promissory note outlines the terms of the loan and the borrowers promise to pay. At this point, the borrower transfers the real property interest to the trustee.
The beneficiary the person who benefits from the trust. The trustee the person who manages the trust.
Generally, as long as the promissory note contains legally acceptable interest rates, the signatures of the two contracted parties, and are within the applicable Statute of Limitations, they can be upheld in a court of law.
