Steps for disputing an eviction Apply for dispute resolution and pay the filing fee for a dispute resolution application. Landlords can legally evict tenants with a One Month Notice to End Tenancy (PDF, 2.1MB) RTB Form 33 for not following legal responsibilities under the tenancy agreement or Residential Tenancy Act (RTA).
Response to notice Tenant If a tenant objects to the reasons stated for the eviction in a 14-day notice, they must: give the landlord a written explanation of why they disagree. give the written objection to the landlord before the 14 days are over.
If tenants are served with a 3 Day Notice to Pay or Vacate, and if they dont pay, the eviction process in California can start on the 4th day.
A landlord cannot: Physically evict a tenant. Change the locks without an order from the RTB. Take a tenants personal property without a court order.
You will then have to act very quickly to try to stop the eviction. You must file a Motion to Set Aside an Ex Parte Order with the Board as soon as possible. But to be safer, you must do this within 10 days after the date of the order. You can get forms for filing this motion from the Board.
If your tenant is late paying by even one day, or the rent is short by any amount of money, the landlord has the right to serve them with a 10 day eviction notice for non-payment of rent. Tenants have 5 days to dispute their eviction and apply for dispute resolution after receiving a 10 day notice.
A tenant can be evicted within ten days if they miss a payment. Depending on the reason for eviction, the landlord needs to provide 10 - 120 days of notice. Tenants have a ranging window to dispute the eviction with the Residential Tenancy Branch (RTB).
