Once the vote has been counted, we must serve 72 hours strike notice before any job action can be taken. This means we cannot do any job action for 72 hours. What is the difference between a full strike and job action? Job actions are smaller activities that we can do.
During a strike or lockout, picketing is not mandatory. However, workers who choose not to picket cannot return to work and will not receive any compensation from the union or the employer.
Equally, you do not have to take part in a strike and cannot be disciplined by your union if you refuse, although such a decision could potentially create difficulties with colleagues opposed to your choice.
The union must receive a strike mandate from its members. Strike mandates are received by holding strike votes and receiving the support of the majority of employees. Strike votes are valid for 60 days. If a strike does not occur within the 60-day period, a new strike vote is required.
Many courts have held that unions have the power to discipline their members. This discipline can include imposing a docHub fine upon and then suing you to enforce the payment of the fine. If you wish to avoid consequences like that, you cannot remain a member of the union and cross the picket line.
PSACs Constitution outlines disciplinary action that can be taken against members, including a fine that equals the amount of daily renumeration earned by the member, multiplied by the number of days that the member crossed the picket line, performed work for the employer, or voluntarily performed struck work.
You have the right to refuse to cross a legal picket line without fear of discipline. A picket line is considered legal unless it is found to be illegal either by a Labour Relations Board ruling or by the courts. An employer does not get to decide the legality of a picket line.
