A strike is an action taken by a group of employees who stop working in an attempt to pressure their employer into meeting their demands. Workers strike over a wide array of issues, but the most common demands include higher wages, safer working conditions and better benefits.
Can I collect Employment Insurance while on strike or locked out? No, however, if a member is already in receipt of Maternity or Sick Benefits at the time of the job action through EI they are entitled to continue to receive payments.
Most strikes are protected, but certain kinds of strikes are not protected, depending on the object or purpose of the strike, on its timing, or on the conduct of the strikers. You can be lawfully fired for participating in an unprotected strike. When a protected strike ends, you are entitled to return to work.
A work-to-rule is considered strike action even if there are no picket lines that can be crossed. If you notice a member who is not following the work-to-rule, speak to them and make sure they are aware of the strike action.
A strike is lawful if it is an economic strike or an unfair labor relations strike. Some unions have strike funds that can give workers some pay while on strike. Only a few states allow striking workers to receive unemployment benefits if the strike lasts more than a certain amount of time.
The union must receive a strike mandate from its members. Strike mandates are received by holding strike votes and receiving the support of the majority of employees. Strike votes are valid for 60 days. If a strike does not occur within the 60-day period, a new strike vote is required.
There is no time limit on a strike in Ontario (or anywhere else in Canada). A private sector strike will continue until an agreement is docHubed, one side gives in or the company goes out of business. Public sector strikes usually end with an agreement as governments dont go out of business.
During a strike or lockout, picketing is not mandatory. However, workers who choose not to picket cannot return to work and will not receive any compensation from the union or the employer.
