A Pennsylvania mechanics lien places a hold on the title to property. A mechanics lien appears on any title search of the property. If an owner wants to sell the property at some point in the future, a title search will immediately alert a buyer to the lien claim.
The Pennsylvania Mechanics Lien Release Form is used to cancel a lien that has already been filed. Its most often used to release a lien claim after a lien claimant receives payment. However, they may also be released based on settlements, legal controversies, because they expired, or more.
Any party may preliminarily object to a claim upon a showing of exemption or immunity of the property from lien, or for lack of conformity with this act. The court shall determine all preliminary objections. If an issue of fact is raised in such objections, the court may take evidence by deposition or otherwise.
How Is Priority Determined? Liens generally follow the first in time, first in right rule, which says that whichever lien is recorded first in the land records has higher priority than later recorded liens.
Once filed, a Pennsylvania mechanics lien will be valid for a period of two years, unless the property owner provides an extension in writing.
