Some common Class 4 felonies include aggravated assault, drug possession of a controlled substance, driving on a revoked drivers license, and more. Incidents that can result in Class 4 felony charges will typically lead to the defendant being arrested and placed in custody.
Illinois statutory law outlines a specific set of best practices and procedures which allow judges great latitude in sentencing, however certain mitigating factors may be raised by competent counsel which can help to adjust a sentence during the courts review.
After being convicted of two serious or violent felonies (i.e., obtaining two strikes), a subsequent commission of any felony, regardless of violent or nonviolent, will result in a third strike and a corresponding enhanced sentence.
If injuries are the aggravating factor, this means you either caused great bodily harm to another person or you disfigured them. Aggravated battery in this circumstance is charged as a Class 3 felony, carrying a punishment of a 2 to 5 year prison sentence and a fine of up to $25,000.
